Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Obex mobile applications on iOS and Android, our website at obex.so, and all related services (collectively, the "Service").

By creating an account, downloading the app, or otherwise using Obex, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old (or the minimum age required by applicable law in your jurisdiction) to use Obex. By creating an account, you represent that you meet this requirement.

You are responsible for maintaining the security of your login credentials and for all activity that occurs under your account. You must provide accurate account information.

Obex offers both free and paid features. Certain premium features require an active subscription. Pricing, trial periods, and renewal terms are displayed at the time of purchase.

Subscriptions auto-renew unless you cancel before the end of the current billing period through your app store account settings.

If you downloaded Obex from the Apple App Store or Google Play, your use of the app is also subject to the applicable platform's terms of service.

In the event of any conflict between these Terms and mandatory platform requirements, the platform requirements will take precedence to the extent of that conflict.

Obex includes community features where you can post updates, comments, journal entries, and other content. You retain ownership of your content, but by posting it you grant Obex a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute it as necessary to operate and improve the Service.

You are solely responsible for the content you share and must ensure it complies with applicable law, respects the rights of others, and follows these Terms.

You agree not to misuse the Service, interfere with its operation, or attempt to gain unauthorized access to any systems or data.

The following activities are strictly prohibited:

Obex and its licensors own all rights, title, and interest in the app, software, design, branding, logos, and related intellectual property, excluding user-generated content.

These Terms grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the app for your personal, non-commercial, lawful purposes. This license does not include the right to modify, distribute, or create derivative works of the Service.

Obex provides habit tracking, accountability tools, wellness content, and faith-based motivational resources. None of this constitutes medical, psychiatric, therapeutic, legal, or financial advice.

The Service is not a substitute for professional treatment. If you are experiencing a mental health crisis, please contact a qualified healthcare provider or emergency services immediately.

We do not guarantee specific outcomes. Your results will depend on your individual circumstances, commitment, and other factors outside our control.

Obex integrates with and may link to third-party services, including but not limited to authentication providers, payment platforms, and analytics tools. We do not control and are not responsible for the content, terms, availability, or privacy practices of these third parties.

Your use of third-party services is governed by their respective terms and privacy policies.

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, Obex and its officers, directors, employees, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of data, revenue, profits, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service is limited to the greater of (a) the amount you paid to Obex in the 12 months preceding the claim, or (b) USD $100.

You may stop using Obex and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, pose a risk to other users, or expose Obex to potential legal liability.

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will remain in effect, including but not limited to payment obligations, intellectual property rights, disclaimers, limitation of liability, and dispute resolution provisions.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

Any disputes arising from or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

We may revise these Terms from time to time as the Service evolves. When we make material changes, we will update the "Last Updated" date at the top of this page and may notify you through the app or by email.

Your continued use of Obex after updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Service.
